Terms & Conditions

This Promotion is open to residents of the United Kingdom (“UK”) and the Republic of Ireland (“ROI”) aged 18 or over. Any persons directly connected with the creation and administration of this Promotion (including but not limited to any employees of the Promoter, its affiliates and its agencies) are excluded from entering this Promotion. The Promoter may request the winner to provide proof of purchase.

Purchase is necessary. Please retain all packaging, as this may be required for validation and in order for the winner to receive their Prize. New packaging must be retained for every new entry. Internet access and a valid email address etc are required.

Please note that while we want to encourage you to participate and enjoy the benefits of the Promotion we believe in responsible consumption of our products. Please do not purchase more product than you can reasonably consume just to participate in this Promotion.

Promotion Period:

1. Instant Win: Enter between 06:00 GMT on the 21 December 2022 and 23:59 GMT on the 20 March 2023 inclusive. Entries are permitted between 06:00 and 23:59 each day, with a Prize allocated by a random winning moment every hour during this time.
2. Wrap Up Draw: Enter between 00:01 GMT on the 21 March 2023 and 23:59 BST on the 20 July 2023 inclusive.

Maximum of 1 entry is permitted per person per hour (between 06:00 and 23:59 each day) during the Promotion Period. Each entry must be accompanied by a new code and packaging. No household (defined as persons living at the same address) may win more than 1 Prize.

Each winner may be required at any time to present the packaging from their promotional pack linked to their winning entry into the Promotion.

Winner Selection:

1. Instant Win: During the Promotion Period, 1,620 “winning moments” (days, hours, minutes, seconds), have been randomly selected by an independent verification service. There is a winning moment every hour between 06:00 and 23:59 each day during the Instant Win Promotion Period. The first valid entry on or after that winning moment will be awarded the Prize. If no entry is received between one winning moment to the next, the Prize from that winning moment will be rolled over, creating an additional winning moment. All 1,620 Instant Win Prizes have been made available and it is intended that they will be won.
2. Wrap Up Draw: 10 Winners will be randomly selected from all valid entries received during the Wrap Up Draw Period. The Prize draw will be conducted by PromoVeritas, within 5 working days of the close of the Wrap Up Prize Draw Period. All 10 Wrap Up Draw Prizes will be won.

Prizes:

1. Instant Win: During the Promotion Period, there are a total of 1,620 Prizes of £250 (or € equivalent) cash to be won. There will be 18 Prizes to be won per day (one Prize each hour between 06:00 and 23:59).
2. Wrap Up Draw: 10 winners will each win 1 x £250 (or € equivalent).

Further Prize Details and Conditions:

1. The cash Prize will be paid via BACs.
2. Winners must have a valid UK or ROI bank account.
3. Winners are responsible for providing correct bank account details at the point of claiming their Prize and the Promoter will not be liable for any Prize payments made into the wrong bank account.
4. At all times, the Promoter will have the discretion as to how to implement the Prize fulfilment.
5. The € equivalent value of the Prize for winners resident in ROI will be calculated based on the exchange rate on the day of Prize Acceptance. The exchange rate and calculation will be determined in the Promoter’s sole discretion.

Winner Notification:

1. Instant Win: The provisional winning entrants will be instantly notified on screen and asked to follow the instructions to claim their Prize. Provisional Winners will also receive a confirmation email to their email address used upon entry within 3 working days of on-screen notification, confirming their Prize and will be required to follow the instructions within 14 days of initial contact. If a Winner does not follow the instructions in the confirmation email, within 14 days, the Promoter reserves the right to disqualify that Winner and return the Prize to the promotion Prize pool which may be won by another entrant during the Promotion Period. Any claims received that don’t meet these requirements will be void and invalid and we reserve the right to return the Prize to the Promotion Prize pool which may be won by someone else during the Promotion Period.
2. Wrap Up Draw: The provisional Winners will be contacted via the email address provided on entry within 5 days of Wrap Up Draw Winner Selection and will be asked to provide evidence of identity and eligibility. Reasonable efforts will be made to contact the Winners. If a Winner does not respond to the initial contact within 14 days, the Promoter reserve the right to disqualify that/the entrant and award the Prize to a reserve selected in the same manner. Reserve Winners may have less time to respond.

Prize Acceptance: Once eligibility of a Prize is confirmed and the Prize is accepted, Winners will be notified within 28 days of acceptance of the Prize to arrange fulfilment of the Prize. In the unlikely event that a Winner does not receive their notification within 28 days, the Winner will have a further 28 days to inform the Promoter by emailing lovefromwalkers@promowinners.com. If a Winner does not do so, the Promoter reserves the right to not reissue the Prize or limit its value at its sole discretion.

Provided no objection from the Winners is received, a winners list containing their surname and county of residence will be made available by the Promoter 4 weeks after the close of the Promotion Period, for a period of 8 weeks. It will be at www.promowinners.com/lovefromwalkers. Winners can object to their surname or county of residence being published or request for the amount of information being published to be reduced during the Winner Notification process. However, without prejudice, the Promoter will provide Winner information to the Advertising Standards Authority on reasonable request.

The Promoter may request that the Winners participate in reasonable publicity arising from the Promotion. Participation is at the Winner’s discretion and is not a condition of Prize Acceptance.

The Promoter seeks to run a fair and secure promotion and prevent abuse and cheating. If you enter in a way that is not consistent with these Terms & Conditions, your entries (and any of your associated aliases) will be disqualified. Any Prize awarded may be void and recoverable, and the Promoter reserves the right to bar you from entering future promotions for a period of at least six months. For this reason, the Promoter reserves the right at any point to:

1. Verify the eligibility of entrants and/or provisional Winners by requesting such information it consider reasonably necessary for this purpose. Entry or a Prize may be withheld until verification is completed.
2. Disqualify entries that are not made directly by the individual entering the Promotion.
3. Disqualify entries made using anonymous email services such as, but not limited to, GuerillaMail, Dispostable or Mailinator.
4. Disqualify bulk entries from individuals, trade, consumer groups or third parties, incomplete entries and entries submitted by macros or other automated means.
5. Disqualify entries beyond the maximum allowed, or those using techniques such as ‘script’, ‘brute force’, multiple SIM cards for text entries, masking identity by manipulating IP addresses, using aliases or identities other than their own or any other means.
6. Disqualify entrants who tamper with the entry process.
7. Disqualify entries which, in some other way, do not meet the requirements of these Terms & Conditions.
8. Cancel, modify or suspend the Promotion should it not be capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, dishonesty, technical failures, or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion.

The Prizes are not transferable or exchangeable. No other form of compensation is available. If for any reason any Prize is not available, the Promoter reserves the right, at its sole discretion to substitute another Prize for it, of equal or greater value.

No responsibility can be taken for entries which are lost, delayed, corrupted, damaged, misdirected or incomplete or which cannot be delivered for any technical, delivery or other reason. Proof of sending will not be accepted as proof of receipt. The Promoter does not guarantee continuous or secure access to microsite.

The Promoter and its associated agencies and companies are not liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion (JS12301) or accepting or using a Prize, except for any liability which cannot be excluded by law. Nothing will exclude the Promotor’s liability for death or personal injury as a result of its negligence.

The Promoter will not be liable for any delay or failure to comply with its obligations for reasons beyond its reasonable control arising from but not limited to Acts of God, global or regional epidemic or pandemic, adverse weather conditions, fire, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, plague or other natural calamities, or any other circumstances of the Promoter.

Any and all personal data provided by you in connection with this Promotion will be used solely by the Promoter (or its appointed agents) to: (i) assist with running the Promotion; and/or (ii) conduct analytics to improve the Promoter’s promotions, products or services. The Promoter (or its appointed agents) will not contact you for reasons other than this Promotion unless you have provided your express consent. All personal data will be handled in accordance with the Promoter’s privacy policy, available at https://www.walkers.co.uk/privacy-policy.

The Promoter’s decision is final and binding. No correspondence will be entered into.

If any part of these Terms & Conditions are legally ruled to be invalid, illegal or unenforceable, the remainder will not be affected and will continue in full force and effect.

By entering, you will be deemed to have agreed to be bound by these Terms & Conditions.

If there is a discrepancy between these Terms & Conditions and those in any promotional material, these Terms & Conditions will prevail.

These Terms & Conditions are governed by English law and their interpretation and application will be subject to the exclusive jurisdiction of the courts of England and Wales.

In the Republic of Ireland this promotion is being carried out:

1. to 31 January 2023 under a lottery licence granted by the Dublin Metropolitan District Court on 16 March 2022; and
2. from 1 February 2023 under a lottery licence granted by the Dublin Metropolitan District Court on 30 November 2022.

The lottery license is held by Pieta House of First Floor Greenhills Retail Park, Greenhills Road, Tallaght Dublin 24, Dublin (Charity No: CHY16913).

Keep your Heart Shaped Crisp and the packaging as we will require it to validate your claim. The Heart Shaped Crisp provided on entry must be the crisp that is produced at Shortlist Notification and Winner Notification. If not you will be disqualified. New packaging and Heart Shaped Crisp must be retained for every new entry (maximum of one entry per person per social media platform). Internet access, a valid email address, an Instagram or Twitter account are required.

Promotion Period: Enter between 06:00 GMT on the 21 December 2022 and 23:59 GMT on the 20 March 2023 inclusive.

To Enter: Purchase a pack of Walkers potato crisps (excluding Walkers Baked, Walkers Sensations and Walkers MAX), if you find a Heart Shaped Crisp take a photo of it and:

1. Twitter: Login to your Twitter account (or create one for free), follow @walkers_crisps and tweet your picture, include the hashtag #lovefromwalkers and tag @walkers_crisps to be entered into the competition.
   And/or
2. Instagram: Login to your Instagram account (or create one for free), follow @walkers_crisps and upload your picture, include the hashtag #lovefromwalkers and tag @walkers_crisps to be entered into the competition.

All entries must meet the following requirements (as determined by the judge in their sole discretion) to be eligible to enter the Promotion. For the avoidance of doubt if any of these requirements are not met the entry will not be judged.

Image requirements

• None of the crisp can be out of frame of the picture
• Keep a reasonable border (approximately 1cm) between the edge of the image and the crisp
• The image must be in focus so the whole crisp is clear enough to be accurately judged
• The whole crisp must be visible and unobstructed. Entrants are asked not to hold the crisp and take their picture on a flat surface. Entrants must not include their hands or face in the picture.

You must keep your profile on a public setting and continue to follow the @walkers_crisps account for 4 weeks after the end of the Promotion Period in order to be contacted if you are selected as a winner. A crisp may only be used once to enter. The crisp used to enter the promotion must be a Walkers potato crisp from a Participating Product.

6. Entrants must only submit images that are their own work or that they have permission to use.
7. Any images that have been doctored, enhanced or altered in any way will be disqualified.
8. By submitting an entry, each entrant grants to the Promoter a non-revocable, perpetual, worldwide, royalty-free licence to use the copyright and other intellectual property rights vesting in their entry image for all purposes, including but not limited to display on the Promoter’s website and any other website of the Promoter or its agents/contractors choosing and use of the entry, or part(s) of the entry, in marketing materials relating to this Promotion. Each entrant also grants the Promoter and its agents/contractors the right to moderate, modify or remove any entry if it is deemed unsuitable, in whole or in part, for display on the Promotion website or in any materials relating to the Promotion. Entrants hereby represent and warrant that they have all rights necessary to grant the licence and rights provided for in this paragraph and that all materials forming part of their entry to this Promotion, and any use of such materials by or on behalf of the Promoter, comply with all applicable laws, rules, and regulations and do not infringe or otherwise violate the intellectual property or other rights of any third party.
9. All entrants hereby irrevocably and unconditionally assign to the Promoter with full title guarantee (and by way of present assignment of present and future rights) all intellectual property rights in any images or footage throughout the world for the full unexpired period of such rights and all renewals, reversions and extensions of such period as may be provided under any applicable law throughout the world.
10. Each entrant warrants and represents that any pictures or images used in connection with this Promotion: (i) is original to them (ii) is submitted in good faith and (iii) has been legally obtained and created.
11. Each entrant undertakes to the Promoter that their entry does not: (i) infringe the intellectual property, privacy or publicity rights or any other legal or moral rights of any third party, or violate applicable laws, regulations or terms of use; (ii) does not contain references to any other brands or trademarks; AND (iii) does not contain any defamatory, malicious, indecent, threatening or otherwise inappropriate imagery or statements, or represent a danger to health and safety. Each entrant agrees to indemnify the Promoter for any loss, damage or liability arising should this provision be breached. If relevant, the Promoter reserves the right, but not the obligation (and without limiting entrants' warranty and indemnity as set out above), to screen, filter and/or monitor information provided by the entrant and to edit, refuse to distribute or remove an entry.
12. By submitting an entry, entrants confirm that they have the right, power and authority to grant the rights set out above and that they have obtained all consents and permissions necessary to grant the Promoter the same.

Shortlist Selection: All valid entries received during the Promotion Period (subject to moderation) will be independently judged within 10 working days from the close of the Promotion Period to select 20 shortlisted entries based on the following criteria:

1. How much of a point, as opposed to a curve, is there at the bottom of the Heart Shaped Crisp? Scored out of 10.
2. How symmetrical are the two curves at the top of the Heart Shaped Crisp to each other? Scored out of 10.
3. How arched are the two curves at the top of the Heart Shaped Crisp? Scored out of 10.
4. How in line is the meeting point of the two curves at the top of the Heart Shaped Crisp to the bottom point of the heart shaped crisp? Scored out of 10.
5. How symmetrical are the two downward sloping sides of the Heart Shaped Crisp to each other? Scored out of 10.
6. How straight are the two downward sloping sides of the Heart Shaped Crisp? Scored out of 10.

All shortlisted entries will be run through software which indicates whether a photo has been edited.

Any photos or video that are highlighted as being edited will be disqualified and the next top scoring entry will be added to the shortlist. Entrants acknowledge and agree that the Promoter’s decision shall be final in this respect.

Shortlist Notification: All shortlisted entrants will be contacted via the social media account used to enter within 5 working days of Shortlist Selection and will be asked to arrange a video call with the Promoter in order to verify their crisp and to provide evidence of identity and eligibility. Reasonable efforts will be made to contact the shortlisted entrants. If a shortlisted entrant does not respond to the initial contact within 14 days, the Promoter reserves the right to disqualify that shortlisted entrant and the next top scoring entry will be added to the shortlist. If a shortlisted entrant is unable to show their Heart Shaped Crisp used to enter on a video call, they will be disqualified, and the next top scoring entry will be contacted. Prior to the video call taking place, shortlisted entrants will be required to sign a declaration confirming their eligibility and compliance with these Terms & Conditions.

Winner Selection: Following Shortlist Notification, all successfully validated shortlisted entrants will be judged by a panel of judges, within 5 working days from Shortlist Notification to select 1 winner based on the same criteria.

Winner Notification: The provisional winner will be contacted via the email address provided on entry within 5 working days of Winner Selection and will be asked to arrange a home visit for the Promoter to validate their Heart Shaped Crisp and for the provisional winner to provide evidence of identity and eligibility. Reasonable efforts will be made to contact the provisional winner. Once eligibility has been confirmed, and the Heart Shaped Crisp has been validated the provisional winner will be confirmed as a winner. If the provisional winner does not respond to the initial contact within 14 days, we reserve the right to disqualify that entrant and award the Prize to a reserve selected in the same manner. Reserve winners may have less time to respond.

Prize Acceptance: Notification to arrange fulfilment of the Prize will take place within 28 days of acceptance of the Prize. In the unlikely event that the winner has not received communication to arrange their Prize the winner must inform the Promoter by emailing heartshapedcrisp@promowinners.com. If the winner does not do so, the Promoter reserves the right to not reissue the Prize at its sole discretion.

Moderation: The Promoter reserves the right to reject entries which, in the reasonable opinion of the Promoter:

1. are in breach of the Terms & Conditions;
2. contain any content that is offensive, harmful, objectionable or which is otherwise unsuitable for publication including with respect to race, religion, origin or gender, or which could reflect negatively upon the name, reputation or goodwill of the Promoter or any brand partner;
3. contains or refers to any unauthorised third-party brand or references any third-party names, logos and/or trademarks;
4. promotes any political agenda.

Provided no objection is received from the winner, a winner list containing the surname and county of residence of the winner will be made available by the Promoter 1 week after Prize Acceptance, for a period of 8 weeks. It will be available at www.promowinners.com/heartshapedcrisps. The winners can object to their details being published during the Winner Notification process. Without prejudice, the Promoter will provide winner information to the Advertising Standards Authority when requested by them.

The Promoter may request that the winners participate in publicity arising from the Promotion. Participation is at the winner’s discretion and is not a condition of Prize Acceptance.

If requested by the Promoter in its absolute discretion, the Winner may be required to submit to a confidential background check or to provide suitable information to answer questions to confirm eligibility and help ensure that the use of any such person or their entry in advertising or publicity for the Promotion will not bring the Promoter into public disrepute, contempt, scandal or ridicule or reflect unfavourably on the promotion as determined by the Promoter in its sole discretion. This will include all relevant banning orders or related incidents regarding the Winner at any venue as required by the government, the police or relevant law enforcement agencies or organisations. Part of this process may also include questions during the claim process and a review of personal information sourced from data available in the public domain. This will not impact on the winner’s eligibility to win or accept the Prize.
